強烈譴責中國當局對郭泉先生的非法判刑及監禁:
原為南京前大學教授及法官之郭泉,在二零零七年發起成立中國新民黨。他曾經在網上撰文及發表致胡錦濤等領導人的公開信,提出在中國建立「全面福利條件下的多黨競選的民主政治體制」。他也曾就下崗工人人權、勞動教養制度等問題致函國務院總理溫家寶。並在網上發表抨擊川震豆腐渣工程等文章。在被多次拘留之後,在去年十一月被當局以「涉嫌顛覆國家政權罪」被正式拘捕。 我們強烈譴責當局公然侵犯郭泉在中國憲法下享有的言論自由;並對法院在審訊兩個多月後才判刑,嚴重違反中國《刑事訴訟法》的法定時限的做法深表遺憾。我們亦關注內地日益退步的人權狀況:中國在簽署了《聯合國政治及公民權利公約》十年後的今天,對於保障基本人權及法治、依然毫無尊重和承擔。 更令我們深感不安的是,「顛覆國家政權」及「涉嫌顛覆國家政權」這些定義含糊的罪名常被用作針對異見人士的打壓工具,加劇內地言論自由之寒蟬效應。 故此,我們強烈要求當局立即無條件釋放郭泉先生、廢除「顛覆國家政權」及「涉嫌顛覆國家政權」等定義含糊的罪名,並促請中國政府充分尊重人權和法治。
Condemning the Illegal Imprisonment of Mr. Guo Quan: On 16 October 2009, Chinese democracy activist Guo Quan was sentenced to 10 years for "subversion of state power" by a court in eastern Jiangsu Province. This marks another high-profile crackdown on political dissidents following that on Liu Xiaobo, Tan Zuoren, Wang Qui, Xu Zhiyong and Xie Zhangfa. Guo, a former university professor and former judge in Nanjing, founded the China New Democracy Party in 2007. He has published articles online and written openly to party leaders including President Hu Jintao, advocating a multiparty democracy in China with competitive elections. Besides his online criticisms of the “jerry-built” constructions in Sichuan, he has also addressed social problems concerning laid-off workers and reeducation through labour to Premier Wen Jiabo. Having been detained numerous times, he was arrested in Nanjing last November. His sentencing more than 2 months after trial was contrary to the ‘one-and-a-half month’ rule prescribed under the Chinese Criminal Procedure law. We condemn the authorities’ blatant violations of Guo’s freedom of expression under the Constitution of the PRC, and the procedural illegality under the Chinese Criminal Procedure Law. We deplore the deteriorating human rights situations in China: 10 years after China’s signing of the International Covenant on Civil and Political Rights, it still fails to demonstrate due respect or commitment to safeguarding the fundamental rights and the rule of law. Further, we are deeply disturbed that the Chinese authorities continues to prosecute political dissidents under loosely defined charges such as “subversion of state power” and ”inciting subversion of state power”. We believe these offences intensify the chilling effect on the freedom of expression in the country. We demand the immediate and unconditional release of Mr. Guo Quan and that the subversion offences be abolished with immediate effect, and urge the Chinese government to give due respect to human rights and the rule of law.
